David Weaver’s Expertise With a career in energy and like many Texas landowners, I have over the years collected oil and gas royalties that have declined to the point that income hardly covers the cost of ownership. Every time an operator changes, and that is often for small interests, you must file new paperwork. Then there are forms needed for your tax return, and eventually your estate tax return, that your accountant and executor can spend valuable time tracking down and reporting. And a new dynamic has emerged as opposition to fossil fuels and more particularly ownership of oil and gas royalties grows. After multiple generations of ownership, mineral interests across the US have become highly fractionated. For instance, in Texas there are over 10,000 oil and gas leases with at least 100 owners. At the same time, most legacy oil and gas wells are largely depleted while newly developed shale wells are flush with production. The net effect-- royalty interests associated with Texas’ 107,000 active leases have a 30,000 average value but only a 450 median value. With half of Texas royalty interests being worth less than 450 and generating maybe 20/month of income on average, there is virtually no market for such interests, short of an insider. Alternatively, and as with old cars and other de-valued assets, a donation to a tax-exempt organization (TEO) at least generates a tax deduction for you and can provide valuable funding for preferred TEOs. Our statistical analysis indicates that the donation of royalties appraised at up to 5,000 should be pursued as a viable alternative to ownership. With these targeted royalties valued at about 2.5 billion, participation by only a small percentage of the roughly 500,000 owners still translates into approximately 20 million of value generated every year for TEOs. The "acquisition" and "disposition" processes must be very targeted and highly automated. Likewise, the focus must be on leases with highly fractionated ownership where there are aggregation opportunities that can enhance the aggregated value disproportionately.
