Steven Shermer’s Expertise As a Senior Attorney with the U.S. Department of Justice Environmental Enforcement Section, I am responsible for managing complex civil environmental matters. I work under most major federal environmental laws, and have particular experience with the Clean Air Act and process safety management issues. My work has spanned a variety of industries including petroleum refining, transportation pipelines, petrochemicals and plastics, sulfuric and nitric acid manufacturing, container and flat glass production, municipal wastewater treatment plants, and others. I routinely coordinate with federal and state agencies and officials, as well as with regulated private interests. I build consensus among divergent interests, with the goal of forging successful solutions. I also supervise and am responsible for ensuring the productivity and success of other trial attorneys. I believe that simple skills lay the foundation for success, but are often overlooked or taken for granted: * Listening - understanding client objectives, identifying areas of common and incompatible interests with other parties, and deciding whether workable solutions exist is impossible without active listening. Lawyers love to talk. They should listen more. * Communicating - regularly, clearly, succinctly. Time is precious. And time gets wasted because of insufficient, mis-, or unclear communications. Client relationships suffer for the same reasons. Negotiations often do too. * Honest, frank advice - I vigorously advocate to achieve my clients' objectives. But that advocacy is coupled with frank, upfront, and ongoing discussions about risks, realistic outcomes, and the costs of different options. Though sometimes difficult, candid case evaluation provides decision-makers with the best possible information to save time and resources over the long-term. It can avoid disputes altogether or shorten the time to resolve them. * Cooperating and collaborating - I lead project teams and work as a member of them. Navigating the complex issues that federal and state environmental laws present requires teams of attorneys, technical personnel, and professional staff. An effective attorney must be able to lead those teams and bring out the best of each member.
